CJI Bobde takes exception to ‘Your Honour’: Don’t use incorrect terms


The SUPREME Court on Tuesday opposed a petitioner addressing judges as “Your Honor”, ​​and recalled that this is how judges are treated at the United States Supreme Court.

“When you say Your Honor, you have either the Supreme Court of the United States or the magistrate in mind,” said Chief Justice of India SA Bobde, at the head of a bench of three judges. , in the petition of a law student asking for the intervention of the court in ensuring that the vacant magistrate positions are filled to fight against the backlog of cases, they were heard.

Apologizing, the petitioner said he will use “My Lords”. To that, CJI Bobde replied, “It doesn’t matter. But don’t use incorrect terms. “

The bench then adjourned the case for four weeks, observing that the petitioner did not appear to have done his homework properly and asked him to study further and return.

Shrikant Prasad’s plea highlighted the backlog of cases in subordinate courts and argued that the main reason was the lack of judges, support staff and the necessary infrastructure. He urged the Supreme Court to order the authorities to fill vacant posts within a limited timeframe and also to increase the number of judges in lower courts.

Interestingly, CJI Bobde had objected to a lawyer addressing judges as “Your Honor” in August 2020 as well, and asked him if he was appearing in the United States Supreme Court.

CJI then reminded him that this was not accepted practice in Indian courts.
